Terms of Service

These terms are the agreement between you and Uprite, a trading name of Hamza Erdem Turfanda ("Uprite", "we", "us") when you use useuprite.com or buy anything from us. By placing an order you accept them.

If you do not accept them, do not order.

1. Who we are

2. Who can buy

You must be at least 18 and able to enter a contract. We ship to US addresses only.

3. Orders

Your order is an offer to buy. The contract forms when we send you a shipping confirmation, not when you click the button and not when your card is authorized.

We can refuse or cancel an order, and we will refund you in full if we do. Reasons include: the item is out of stock, the price or description was wrong, we could not verify your billing information, the order looks fraudulent, or the order looks like it is for resale.

4. Prices and payment

All prices are in US dollars.

Prices can change at any time, but never after you have placed an order.

Sales tax is calculated at checkout based on your shipping address, where we are required to collect it.

If a price is obviously wrong, for example a $79 cushion listed at $7.90, we may cancel the order and refund you rather than honor the error. We will tell you what happened.

Any "compare at" price shown next to a product is our own regular list price for that product on this site, not a competitor's price and not a manufacturer's suggested price.

5. What the product is, and what it is not

Uprite sells a height-adjustable lumbar support cushion for chairs. It is a seating accessory.

It is not a medical device. Nothing on this site is medical advice, and nothing we say is a diagnosis, a treatment, or a promise about a diagnosed condition. If you have a back condition, or you are recovering from an injury or surgery, talk to your own clinician before changing how you sit.

Product photography, dimensions and specifications are given as accurately as we can. Colors vary between screens. Stated dimensions are nominal and may vary slightly between production runs.

6. Shipping, returns and refunds

Shipping times, costs and origin are set out in the Shipping policy. Returns, the trial period and refunds are set out in the Refund and Returns policy. Both of those pages form part of these terms.

Risk of loss passes to you on delivery, not on dispatch. If it does not arrive, that is our problem to solve.

7. Your account

If you create an account, keep your password to yourself. You are responsible for what happens under your account. Tell us if you think someone else is using it.

8. Using the site

You may not:

• Scrape, crawl or harvest the site beyond ordinary browsing.
• Copy our text, photography, layout or code for another store.
• Buy for resale on Amazon, eBay, Walmart or any other marketplace without our written agreement.
• Interfere with the site's operation or security.
• Submit false, abusive or someone else's content.

9. Reviews and anything you post

If you send us a review, a photo or a comment, you keep ownership of it and you give us a non-exclusive, royalty-free license to publish it on the site, in email and in advertising, with the first name and state you provided.

You confirm it is your own genuine experience with the product, that you were not paid for it, and that you have the rights to any image you send.

We publish real customer reviews or none at all. We do not write reviews, buy reviews, or suppress negative reviews to change the average rating.

10. Intellectual property

The Uprite name, the site design, the photography and the copy are owned by us or licensed to us. You may not use them without written permission.

11. Warranty

The warranty we offer is set out in the Refund and Returns policy.

Apart from that warranty, and apart from any rights your state gives you that cannot be waived, the product and the site are provided "as is". We disclaim implied warranties of merchantability and fitness for a particular purpose to the fullest extent the law allows.

Some states do not allow that disclaimer, in which case it does not apply to you.

12. Limitation of liability

To the fullest extent the law allows, our total liability to you for anything connected with a purchase is limited to the amount you actually paid for that order.

We are not liable for indirect, incidental or consequential loss, including lost income or lost time.

Nothing here limits liability for fraud, for personal injury caused by our negligence, or for anything else that cannot be limited by law.

13. Indemnity

You agree to cover our reasonable costs if we are sued because you broke these terms or misused the site.

14. Disputes

Talk to us first. Email support@useuprite.com and give us 30 days. Almost everything gets solved here, and it costs you nothing.

Then, if we still cannot agree. You keep every right you would otherwise have. We do not ask you to give up going to court, we do not require arbitration, and we do not ask you to waive class or collective actions. If a dispute cannot be settled between us, you may bring it wherever the law entitles you to bring it, which for most customers is the courts where you live.

Chargebacks. Please email us before you dispute a charge with your bank. A refund we issue directly reaches you faster than a chargeback does, and it costs neither of us anything.

15. Governing law

Uprite sells from the Netherlands. These terms are governed by Dutch law.

That does not take anything away from you. If you are a consumer, you keep the mandatory consumer protections of the country you live in, including any US federal or state consumer protection law that applies to your purchase, and nothing in these terms overrides them.

16. Changes

We may update these terms. The version that applies to your order is the one published when you placed it.

17. Everything else

If a section is found unenforceable, the rest still stands. If we do not enforce something immediately, we have not given up the right to enforce it later. These terms, plus the shipping, refund and privacy policies, are the whole agreement between us.
